These Terms & Conditions (“Terms”) govern the use of this website and the design services provided by Anna Fong Design (“Designer,” “I,” or “me”). By accessing this website or engaging services, you agree to the following terms.
1. Independent Service Provider
Anna Fong Design operates as an independent design service provided by an individual designer, not as a full-service agency, development firm, or employer.
No partnership, joint venture, employment, or agency relationship is created by engaging my services.
2. Scope of Services
Service descriptions on this website are provided for general reference only.
Specific deliverables, timelines, scope, and fees are defined per project through written agreement, proposal, or email confirmation.
Project outcomes may vary based on client feedback, responsiveness, scope changes, and external factors.
No specific results, business outcomes, or performance metrics are guaranteed.
3. Design Process & Revisions
Revisions are part of the design process and are intended to refine work within the originally agreed project scope.
“Unlimited revisions,” if referenced, apply only to reasonable design adjustments and do not include:
New features or functionality
Additional pages or sections
Expanded scope beyond the original agreement
Any work outside the agreed scope may require additional fees and a separate agreement.
4. Payments & Refunds
All deposits and payments are non-refundable once work has commenced, as time, resources, and creative labor are immediately allocated to the project.
Refunds are not guaranteed and, if considered, are determined solely at the discretion of the Designer and must be agreed upon in writing.
5. Client Responsibilities
Clients agree to:
Provide timely feedback, content, and approvals
Review deliverables promptly
Communicate clearly and professionally
Delays caused by incomplete information, lack of feedback, or changes in direction may affect timelines and deliverables.
6. Intellectual Property
Unless otherwise agreed in writing:
Final deliverables become the client’s property upon full payment
The Designer retains the right to display completed work in portfolios, case studies, or promotional materials unless explicitly restricted by the client in writing
7. Confidentiality & Privacy
Client information and materials are handled in good faith and are not intentionally made public without consent.
Temporary visibility during development, testing, staging, or review phases does not constitute public publication or data disclosure.
8. Portfolio & Case Studies Disclaimer
Any portfolio examples or case studies displayed on this website are for illustrative purposes only and do not represent guaranteed outcomes or identical results for future projects.
9. Limitation of Liability
To the maximum extent permitted by law, the Designer shall not be liable for:
Indirect, incidental, consequential, or special damages
Loss of profits, business opportunities, or data
Claims arising from subjective dissatisfaction or differing expectations
Total liability, if any, shall not exceed the total amount paid for the specific project in question.
10. Dispute Resolution & Governing Law
Any disputes arising from services provided shall be governed by the laws of the State of California, without regard to conflict of law principles.
Both parties agree to attempt informal resolution before pursuing formal legal action.

Content on this website does not constitute a binding offer or contractual commitment.
Submitting a contact form or inquiry does not create a client relationship or guarantee services.
